A federal grand jury in Virginia has indicted former FBI Director James Comey on two charges related to his testimony to Congress.
Comey is accused of lying during his September 2020 testimony regarding whether he authorized the leak of classified information to the media. In response to his indictment, Comey asserted his innocence and expressed confidence in the federal judicial system.
The indictment comes in the wake of a call from US President Donald Trump to the Justice Department to intensify investigations into his political opponents, including Comey.
The case is being led by Lindsey Halligan, the newly appointed US Attorney for the Eastern District of Virginia. Comey’s arraignment is set for October 9 in Alexandria, Virginia.
Comey faces charges of one count of making false statements and one count of obstruction of justice. The charges stem from his statements to the Senate Judiciary Committee indicating he had not authorized anyone at the FBI to act as an anonymous source in media reports related to his conversations with Trump about the investigation into Russian interference in the 2016 elections. The second charge alleges that Comey attempted to influence and obstruct the Senate’s inquiry.
This indictment marks the first time an ex-FBI director has faced criminal charges.
If convicted, Comey could face a maximum of five years in prison. His attorney, Patrick Fitzgerald, has indicated they look forward to defending Comey in court.
In a video statement, Comey remarked, My family and I have known for years that there are costs to standing up to Donald Trump. We will not live on our knees, and you shouldn't either, reinforcing his claim of innocence as he approaches trial.
