LOS ANGELES (AP) — A federal judge has dismissed a criminal case against Carlitos Ricardo Parias, a well-known TikTok streamer, due to violations of his constitutional rights while in immigration detention. This decision coincides with Parias’ growing prominence for documenting police and immigration enforcement activities on social media.
Judge Fernando Olguin ruled on Saturday to dismiss the indictment against Parias, stating that his defense attorneys were unjustly denied access to him while he was detained for immigration issues. The court noted, The government’s failure to coordinate actions across different agencies led to significant constitutional violations. The dismissal prevents the government from re-filing the same charges against him.
The U.S. Attorney’s office has expressed strong disagreement with the ruling and is evaluating its options for appeal. Parias was indicted last month on charges of assault on a federal officer using a deadly weapon after an incident in which he allegedly rammed his vehicle into a federal officer's vehicle. He was shot during this incident but had been released on bond pending trial.
