In a dramatic turn in the legal battle surrounding the January 6 Capitol riots, defense attorneys for Brian J. Cole Jr. are asserting that a clemency act by former President Donald Trump should apply to their client, who is charged with planting pipe bombs near both the Democratic and Republican national committee headquarters on the eve of the riots.
Cole's lawyers argue that his actions on January 5, 2021, are inextricably tethered to the events that transpired at the Capitol the following day, suggesting that his case should be dismissed as part of the broader clemency granted to over 1,500 individuals by Trump.
Prosecutors have yet to officially respond to this claim but previously noted that during an interrogation, Cole denied any connection between his actions and the insurrection that disrupted Congress's certification of President Joe Biden's election victory.
Cole is reported to have been arrested nearly a year after the incident, bringing attention to a case that both confounds and intrigues law enforcement, who struggled for four years to identify the suspect associated with the pipe bombs.
Cole's lawyers highlighted the government's own narrative, which they claim links Cole's alleged conduct to the motives behind the January 6 actions, maintaining that he was swept up in the same political fervor that energized the rioters.
Despite facing serious charges, Cole's attorney has asked for pretrial release, citing his mental health struggles, which include autism and obsessive-compulsive disorder. However, the judge has yet to set a trial date.
