Top aide Stephen Miller reveals that the Trump administration is contemplating suspending habeas corpus, igniting a legal debate surrounding the protection of individual liberties amid immigration enforcement actions.


In a controversial move, the Trump administration is reportedly "actively looking at" the option to suspend habeas corpus—the legal right that allows individuals to challenge their detention in court. Stephen Miller, the deputy chief of staff at the White House, stated that the US Constitution permits such suspension in instances of "rebellion or invasion," drawing attention to the current immigration policies being implemented by the administration.

Miller's remarks come on the heels of recent court rulings that have challenged several detentions under the immigration enforcement actions. A federal judge recently ordered the release of a Turkish university student who was held for six weeks after publishing an article critical of Israel. Similarly, another judge intervened to free a Columbia University student detained for advocating for Palestinian rights, citing habeas corpus grounds for their release.

Despite some victories in the courts for individuals contesting their detentions, others have sided with the administration, allowing strict enforcement of its controversial deportation agenda. Miller characterized habeas corpus as more of a "privilege," asserting that Congress has utilized legislation to limit judicial authority over immigration matters.

Legal experts have raised doubts about Miller's interpretation of US law and its implications. Trump had previously indicated a commitment to deport millions, and efforts to expedite these removals have escalated since his re-election. Notably, a federal judge blocked the White House from using a wartime law to deport over 200 Venezuelans, prompting ongoing discussions about the legality of such actions.

Reports suggest that Trump himself is deeply engaged in conversations surrounding the potential suspension of habeas corpus, despite not publicly advocating for it like Miller. Instead, Trump has discussed strategies to counter judicial injunctions against deportations.

Habeas corpus, which means "you shall have the body," is crucial for ensuring that individuals can contest their detention before a judge. Historically, the right has been suspended during four distinct periods, including the Civil War and the aftermath of the Pearl Harbor attack. As this legal and ethical debate continues, questions remain whether the Trump administration will pursue such a drastic measure without Congressional consent.
