The parents of at least two babies sickened in an infantile botulism outbreak are suing the makers of the ByHeart baby formula amid a nationwide recall.
Stephen and Yurany Dexter, of Flagstaff, Arizona, reported that their 4-month-old daughter, Rose, required air ambulance transport to a children’s hospital where she underwent treatment for several weeks this summer. Similarly, Michael and Hanna Everett from Richmond, Kentucky, experienced a medical emergency with their 4-month-old daughter, Piper, who was rushed to a hospital on November 8 due to worsening symptoms.
The lawsuits, filed in federal courts in two states, claim the ByHeart formula consumed by the infants was defective and that the company acted negligently in its distribution. The families are seeking compensation for medical expenses, emotional distress, and other damages.
Both families chose the organic formula for what they believed to be a healthier alternative, leading them to express shock and anger over the ordeal their children went through. “I wouldn’t guess that a product designed for a helpless, developing human in the United States could cause something this severe,” Stephen Dexter lamented.
Health officials reported that the outbreak started in August, with at least 15 infants in several states affected; fortunately, no fatalities have been recorded. Both Rose and Piper received the only treatment available for their condition: BabyBIG, an IV medication derived from donated plasma from individuals immune to the botulism toxin.
Investigations are ongoing following the nationwide recall of ByHeart's formula, which is sold in approximately 200,000 cans each month. The California Department of Health stated that a sample of the formula linked to the sickened infants tested positive for the bacteria that cause botulism.
As of now, it is anticipated that further legal actions may surface against ByHeart, with food safety attorney Bill Marler indicating that the company may be facing a significant legal challenge. ByHeart, while not commenting directly on the litigation, stated they aim to ensure that affected consumers understand the recall and necessary steps to take.
In the cases of both infants, they had initially tolerated the ByHeart formula well. However, soon after their difficulties began, raising concerns and culminating in emergency medical interventions. Thankfully, both children have since improved and transitioned to different formulas.
