The ECHR ruled in favor of Semenya in a case not directly targeting World Athletics but focusing on the Swiss government's failure to ensure her rights. The ruling stated that the Swiss court had not met the required standards under Article 6 of the European Convention on Human Rights, which guarantees the right to a fair trial.

Speaking with BBC Sport, Semenya expressed her profound emotion about the outcome, emphasizing the case's significance extends beyond athletics to fundamental human rights. She stated, "This is bigger than we ever thought. It’s about human rights. It’s about the protection of athletes," aiming to give a voice to those who suffer under similar circumstances.

The ruling does not impact the current World Athletics regulations, which limit the participation of athletes with DSD unless testosterone levels are reduced to meet specific thresholds. These regulations were tested in court before and deemed necessary for fair competition by the governing body of athletics.

Semenya's legal team is now reflecting on the implications of the ruling, aware that this could lead to further legal action in Switzerland, although this may be a lengthy process. Schona Jolly, Semenya’s lawyer, remarked that the ruling validates the athlete’s rights, signaling that the governance of international sport must address the fundamental rights of athletes.

South Africa's Minister of Sports, Gayton McKenzie, condemned the treatment Semenya received and hailed the ruling as a win for justice not only for Semenya but for all athletes facing similar injustices in sports.
