In a Tucson courtroom, a judge originally imposed a ten‑year sentence on Gabriel Horcasitas for the 2021 shooting of Christopher Pelkey. The sentence was overturned after an appeals court found the use of an AI‑generated video of the victim at the hearing was improper.

The video, created by Pelkey’s family, used voice recordings, photos and other media to reconstruct the deceased victim’s appearance and thoughts. Horcasitas’s legal team argued that the clip represented the subjective imagination of the victim’s sister rather than an objective record of the event.

The appellate court agreed, stating the AI footage cross‑ed the evidence line and demanded a new sentencing process. Judge Todd Lang, who oversaw the original trial, had praised the “genuine” tone of the AI message immediately after it was played.

The decision raises questions about the admissibility of synthetic content in courts and the weight it carries on juries and judges. It also reflects a broader debate on how new technologies intersect with the legal system and the rights of victims and defendants alike.
